01Description of the Service

Protocol is a personal tracking, logging, scheduling, inventory, reminder, and research organization tool.

The Service allows users to enter, organize, and track information related to protocols, schedules, dose logs, inventory, notes, reminders, and related research or wellness information.

The Service does not provide medical advice, diagnosis, treatment, prescriptions, dosing recommendations, drug safety determinations, emergency services, or healthcare services.

02Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that:

• You are at least 18 years old
• You have the legal capacity to agree to these Terms
• You will use the Service only in compliance with applicable laws
• Your use of the Service does not violate any law, regulation, court order, agreement, or obligation applicable to you

We may refuse access, suspend accounts, or terminate accounts if we believe a user is underage, using the Service unlawfully, or violating these Terms.

03No Medical Advice

Protocol is not a medical provider, physician, pharmacy, clinic, telehealth service, compounding service, prescription service, emergency service, medical device, or substitute for professional medical care.

The Service, including any content, calculations, schedules, reminders, logs, displays, summaries, labels, categories, notes, or app-generated organization features, is provided for informational and personal tracking purposes only.

The Service does not:

• Diagnose, treat, cure, or prevent any disease or condition
• Provide medical advice
• Recommend any compound, peptide, hormone, medication, supplement, research chemical, or treatment
• Recommend any dose, frequency, route, schedule, cycle, or protocol
• Determine whether any protocol is safe, effective, legal, appropriate, or medically necessary
• Create a physician-patient, provider-patient, pharmacist-patient, or clinician-patient relationship
• Replace consultation with a licensed healthcare professional

You are solely responsible for consulting qualified healthcare professionals before making any health-related decision. Never disregard professional medical advice or delay seeking care because of information entered into, stored in, generated by, or displayed in the Service.

04Emergency Disclaimer

The Service is not intended for emergencies of any kind.

05User Responsibility and Assumption of Risk

You are solely responsible for all information you enter into the Service and all decisions you make based on that information. You acknowledge and agree that:

• User-entered information may be incomplete, inaccurate, outdated, or unsafe
• Calculations, schedules, reminders, inventory estimates, and logs may contain errors
• Notifications may be delayed, missed, disabled, blocked, or inaccurate
• The Service may not detect dangerous, illegal, contraindicated, excessive, unsafe, or medically inappropriate activity
• The Service does not verify the legality, authenticity, quality, sterility, source, safety, efficacy, purity, or labeling of any compound, product, or substance
• You must independently verify all information before relying on it
• You assume all risk associated with your use of the Service and any user-entered protocols or related decisions

You agree that the Service is a tracking and organization tool only. It is not a safety system.

06Legal Compliance

You are solely responsible for ensuring that your use of the Service complies with all laws, rules, and regulations applicable to you, including laws relating to medications, prescriptions, controlled substances, research compounds, peptides, hormones, supplements, imports, exports, possession, use, administration, and distribution.

You may not use the Service to plan, facilitate, promote, conceal, or engage in illegal activity.

We do not sell, supply, prescribe, compound, recommend, verify, approve, or endorse any substance, product, provider, pharmacy, clinic, vendor, protocol, or source.

07Account Registration and Security

You may need to create an account to use certain features. You agree to:

• Provide accurate account information
• Keep your login credentials secure
• Maintain control of your device and account
• Notify us if you believe your account has been compromised
• Accept responsibility for all activity under your account

We are not responsible for losses caused by unauthorized account access resulting from your failure to secure your credentials, device, email account, or authentication provider.

08User Content

"User Content" means information, data, text, notes, protocol entries, logs, schedules, inventory details, feedback, or other content you submit, upload, enter, store, or transmit through the Service.

You retain ownership of your User Content. You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, display, reproduce, and use your User Content only as reasonably necessary to operate, provide, secure, support, and improve the Service.

You represent and warrant that:

• You have the right to submit your User Content
• Your User Content does not violate these Terms
• Your User Content does not violate any law or rights of others
• Your User Content is not submitted for unlawful purposes

We do not claim ownership of your User Content.

09Prohibited Uses

You agree not to:

• Use the Service for unlawful, harmful, fraudulent, abusive, or deceptive purposes
• Use the Service to provide medical advice to others unless you are legally authorized and independently responsible for doing so
• Use the Service to prescribe, distribute, sell, source, or recommend controlled substances, prescription drugs, research chemicals, peptides, hormones, or other regulated products
• Use the Service to avoid or delay professional medical care
• Use the Service to harm yourself or others
• Enter information you do not have the right to store or process
• Interfere with or disrupt the Service
• Reverse engineer, scrape, copy, or misuse the Service
• Attempt to bypass security controls or access another user's account
• Upload malicious code or harmful content
• Misrepresent affiliation with us
• Use the Service in a way that could expose us, users, or third parties to legal, security, or regulatory risk

We may suspend or terminate accounts that violate these Terms.

10Subscriptions, Purchases, and Billing

The Service may offer free and paid features. If you purchase a subscription or paid feature through the Apple App Store, Google Play Store, Stripe, RevenueCat, or another payment provider, your purchase may be subject to that provider's terms, billing rules, renewal rules, refund rules, and cancellation procedures.

Subscriptions may automatically renew unless cancelled before the renewal date.

We do not control all app marketplace refund decisions. Refund requests may need to be directed to the app marketplace or payment provider used for the purchase.

We may change pricing, features, subscription tiers, or free usage limits at any time, subject to applicable law and platform rules.

11Third-Party Services

The Service may rely on third-party services, including authentication providers, hosting providers, payment processors, analytics providers, crash reporting providers, app stores, and cloud infrastructure providers.

Your use of third-party services may be subject to their own terms and privacy policies. We are not responsible for third-party services, content, systems, outages, data practices, or policies.

12App Stores and Platform Terms

If you download the Service from the Apple App Store, Google Play Store, or another app marketplace, your use of the Service may also be governed by that platform's terms, policies, and rules.

If there is a conflict between these Terms and applicable app marketplace rules, the app marketplace rules may control solely to the extent required by that marketplace.

13Availability and Changes to the Service

We may modify, suspend, discontinue, limit, or remove any part of the Service at any time. We do not guarantee that the Service will be uninterrupted, secure, error-free, accurate, complete, or available at all times.

You are responsible for maintaining your own records and backups of important information. The Service should not be your only record of important protocol, medical, legal, or safety-related information.

14Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, security, and error-free operation.

We do not warrant that:

• The Service will meet your needs or be uninterrupted or error-free
• Data will always be accurate, complete, secure, or available
• Notifications or reminders will always be delivered
• Calculations or estimates will be correct
• User-entered protocols are safe, legal, medically appropriate, effective, or advisable
• Any tracked compound, product, medication, supplement, peptide, hormone, or research substance is safe, legal, authentic, sterile, pure, effective, or appropriate

You use the Service at your own risk.

15Limitation of Liability

To the fullest extent permitted by law, Protocol, its owners, officers, employees, contractors, affiliates, service providers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, including lost profits, lost data, loss of goodwill, personal injury, health-related damages, medical costs, business interruption, or damages arising from reliance on the Service.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of the amount you paid us for the Service in the 12 months before the claim arose, or $100.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

16Indemnification

You agree to defend, indemnify, and hold harmless Protocol, its owners, officers, employees, contractors, affiliates, service providers, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, and fees, including reasonable attorneys' fees, arising from or relating to:

• Your use or misuse of the Service
• Your User Content
• Your violation of these Terms
• Your violation of law or rights of another person or entity
• Your health-related, medical, legal, or substance-related decisions
• Your reliance on information entered into, stored in, generated by, or displayed in the Service

17Termination

You may stop using the Service at any time. We may suspend, restrict, or terminate your access to the Service at any time if we believe you violated these Terms, created risk for us or others, used the Service unlawfully, or engaged in conduct that may harm the Service, users, or third parties.

Upon termination, your right to use the Service ends immediately. Sections relating to medical disclaimers, user responsibility, intellectual property, prohibited uses, payment obligations, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law survive termination.

18Intellectual Property

The Service, including its design, branding, software, features, text, graphics, logos, icons, interfaces, and other content, is owned by us or our licensors and is protected by intellectual property laws.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service except as expressly permitted by us in writing. No rights are granted except as expressly stated in these Terms.

19Feedback

If you submit ideas, suggestions, bug reports, feature requests, or other feedback, you grant us the right to use that feedback without restriction or compensation to you. We are not obligated to implement, maintain, or respond to feedback.

20Privacy

Our Privacy Policy explains how we collect, use, store, and share information. By using the Service, you acknowledge and agree to our Privacy Policy.

21Dispute Resolution

Before filing a claim, you agree to contact us at support@stayonprotocol.app and attempt to resolve the dispute informally. We will also attempt to resolve disputes informally.

If a dispute cannot be resolved informally, the dispute will be handled according to the governing law and venue provisions below, unless applicable law requires otherwise.

To the fullest extent permitted by law, you and we agree that claims must be brought individually and not as part of a class action, collective action, consolidated action, or representative proceeding.

22Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

To the extent a dispute is not subject to arbitration or another required dispute process, you agree that disputes will be resolved in the state or federal courts located in Texas, and you consent to personal jurisdiction and venue in those courts.

23Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may notify you through the Service, by email, or by posting updated Terms on our website.

The updated Terms will be effective as of the date listed at the top unless otherwise stated. Your continued use of the Service after updated Terms become effective means you accept the updated Terms.
